Well, that was quick. The band formerly know as The Fallen a ' original Evanescence members Ben Moody, John LeCompt and Rocky Gray and American Idol 's Carly Smithson a ' have been given a cease-and-desist order for using the name of an already existing band.

The new band featuring original EVANESCENCE members Ben Moody and John LeCompt and Rocky Gray along with "American Idol" powerhouse vocalist Carly Smithson has reportedly been slapped with a cease-and-desist notice over its use of THE FALLEN moniker.
